Ojasvi Group Inc. (“Ojasvi Group,” “we,” “us,” or “our”) values your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in connection with our websites, professional services, AI solutions, training, events, customer support, and our communications channels—including email and SMS/MMS text messaging. By using our services, you agree to this Policy.

Controller vs. Processor: Ojasvi Group acts as a controller for our websites, marketing, and account management. For client‑provided data we process on their instructions (e.g., consulting deliverables, hosted AI workflows), we act as a processor/service provider; those activities are governed by our service agreement(s) and any Data Processing Addendum (“DPA”) in place. If there is a conflict between this Policy and a DPA for processor activities, the DPA controls.

1) Scope

This Policy applies to information processed by Ojasvi Group in connection with:

  • Our websites and online properties,

  • Professional and advisory services (including accounting/tax, talent enrichment, leadership training),

  • AI agents/workflows and related platforms,

  • Events, webinars, and community engagement,

  • Communications channels (email, chat, and SMS/MMS).
    This Policy does not apply to third‑party sites or services we do not control.

2) Information We Collect

  • Personal Information: name, contact details, role/title, employer, resumes/CVs, credentials, billing and limited payment details (handled via PCI‑compliant processors).

  • Business Information: company data, systems/processes, accounting/financial records, and operational information needed for engagements.

  • Technical & Usage Data: device identifiers, IP address, log data, analytics, cookies/pixels/SDKs, and interaction metadata.

  • AI‑Related Data: inputs, prompts, configuration artifacts, and outputs from AI workflows/agents.

  • Communications Data (incl. SMS): message content, timestamps, phone numbers, delivery status, opt‑in/opt‑out signals, and support interactions.

  • Sensitive Data (limited): we generally do not seek to collect sensitive personal information (e.g., SIN/SSN, financial account numbers beyond last 4, health data, precise geolocation). If such data is necessary for a service, we process it only with appropriate safeguards and lawful bases.

Sources: directly from you; your employer or organization; our service providers; publicly available sources; and automated means (cookies, logs). Where required, we obtain express consent before collection/use.

3) How We Use Information & Legal Bases

We use information to:

  • Deliver and improve our services and websites;

  • Develop, host, and maintain AI agents/workflows;

  • Provide advisory, training, and support;

  • Process payments and maintain records;

  • Communicate about services, account notices, and marketing (including SMS) per your preferences;

  • Ensure security, prevent fraud/abuse, comply with law, and enforce agreements.

Legal Bases (where applicable): consent, contract performance, legitimate interests (e.g., service improvement, security), legal obligations, and vital interests. Marketing SMS and certain cookies/analytics rely on opt‑in consentwhere required.

4) Client Data Accuracy

  • We may rely on data you/your organization provide and are not required to independently verify it.

  • You/your organization remain responsible for accuracy, completeness, and lawfulness of provided data.

  • We disclaim liability for outcomes caused by inaccurate or incomplete client data.

5) Sharing of Information

We do not sell personal information. We may share with:

  • Vendors/Processors (e.g., hosting, analytics, communications/SMS, payment processing) bound by confidentiality and data protection obligations;

  • Professional advisors (legal, tax, audit) under confidentiality;

  • Authorities where required by law or to protect rights;

  • Business transfers in connection with mergers, acquisitions, or financing (subject to safeguards).
    We do not share text messaging originator opt‑in data and consent with any third parties; mobile information is not shared with third parties/affiliates for their marketing/promotional purposes.

6) Cookies, Tracking Technologies & Do‑Not‑Track

We use cookies, pixels, SDKs, and similar technologies for site operations, preferences, analytics, and security. You can control cookies via browser settings; some features may be unavailable without certain cookies.
We honor recognized browser‑based opt‑out signals where required by law (e.g., Global Privacy Control (GPC) in applicable jurisdictions). Industry Do‑Not‑Track standards are not uniform; we respond to DNT only where legally required.

7) SMS/Text Messaging Terms & Privacy

Definitions:
Opt‑in” means your request/consent to receive one or more text messages from us. “Text Message Service” means any service where we send SMS/MMS (or successor protocols) to your mobile number.

Consent & E‑Sign: By opting in (e.g., via form, keyword, checkbox, written/verbal consent, or affirmative reply), you agree to these SMS Terms and consent to use of an electronic record to document your agreement. Withdraw consent by replying STOP.

Program, Frequency & Costs: We may send conversational, informational, and support messages related to our services, appointments, events, and offers. Message frequency varies by interaction. Message & data rates may apply. Consent is not a condition of purchase.

Opt‑Out & Help: Reply STOP (or QUIT/END/REVOKE/OPT OUT/CANCEL/UNSUBSCRIBE) to end; a confirmation may follow. Reply HELP for assistance or contact legal@ojasvigroup.ca. If you interact with multiple Ojasvi numbers/programs, reply STOP in each thread. We maintain suppression lists and will propagate opt‑outs across systems in a reasonable timeframe.

Privacy for SMS Data: We use SMS data only to deliver messages and respond to you, including sharing with platform providers/carriers/vendors who enable delivery. We do not sell/share originator opt‑in or consent data. We may disclose SMS data as needed to comply with law or protect rights.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

Recordkeeping: We retain SMS consent/opt‑out evidence (message text, timestamp, source, number) for 4 years (or longer if required).

8) Security

We employ reasonable technical, administrative, and physical safeguards appropriate to the nature of the data, including encryption in transit, restricted access (least privilege), logging/monitoring, vulnerability management, and secure development practices. Vendor security is assessed as part of onboarding and periodically thereafter. No system is fully secure; incidents beyond our reasonable control may occur.

9) Data Retention

We retain personal and business data only as long as necessary for the purposes described or as required by law (e.g., tax/audit), then delete or de‑identify it. Typical periods: operational records 7 years; marketing preferences and SMS consent/opt‑out 4 years; web analytics per tool configuration (often 13–26 months). We do not guarantee indefinite storage.

10) International Data Transfers

We may transfer personal information to countries outside your own (e.g., Canada, U.S., EU/UK). Where applicable, we use appropriate safeguards such as Standard Contractual Clauses (SCCs), UK Addendum/IDTA, and other lawful mechanisms. We will provide details upon request.

11) Automated Decision‑Making & Profiling

Our AI workflows may perform analytics, scoring, or content generation. We do not make decisions producing legal or similarly significant effects without appropriate human review. Where required by law, you may request information about the logic involved, significance, and envisaged consequences, and you may object or opt out of certain forms of profiling.

12) Your Rights

Depending on your location, you may have rights to access, correct, update, port, restrict, or delete personal information; to withdraw consent for marketing/SMS; to object to certain processing; and to appeal a rights request decision.

Universal Opt‑Out Signals: Where required, we honor recognized browser opt‑out signals (e.g., GPC).
Do Not Sell/Share: We do not “sell” personal information or “share” it for cross‑context behavioral advertising as those terms are defined in some jurisdictions. We limit use of any sensitive personal information to the permitted purposes.

Appeals: If we deny a request, you may appeal by emailing legal@ojasvigroup.ca with “Privacy Appeal” in the subject. We will respond within the timeframe required by law.

13) Children’s Privacy

Our services are not directed to children under 13. We do not knowingly collect their personal information. If you believe a child has provided personal information, contact us to request deletion.

14) Vendor & Subprocessor Management

Vendors/subprocessors accessing personal information are contractually required to employ appropriate security and process data only per our instructions and applicable law. We maintain an internal inventory of vendors and subprocessors; a list can be provided upon request where required.

15) Governing Law & Dispute Resolution

This Policy and any disputes arising from it are governed by the laws of the Province of Manitoba, Canada, without regard to conflict of laws. Exclusive jurisdiction and venue lie in the courts located in Manitoba, unless otherwise required by applicable consumer protection laws or an overriding agreement with you/your organization.

16) Changes to This Policy

We may update this Policy from time to time. Updates will be posted with a revised effective date. Where required by law, we will provide additional notice (e.g., email/SMS or banner) or obtain consent.
